Private Bail Compliance Program

Strike Consulting Inc. offers a private bail compliance monitoring service that is customized and unique to each applicant's case. This program may bolster the individual's position when seeking bail.

The applicant will be asked to sign a Retainer Agreement that compels the Strike Bail Compliance team to inform the Officer in Charge in the event of a breach. This Agreement is between Strike Consulting Inc. and the Law Firm representing the applicant. Strike Consulting Inc. will not take payment from the applicant directly.

As part of the Program, Strike will conduct random home visits (number to be determined by the courts) to ensure the applicant is where they are supposed to be. Home visits may include searches.

Strike's Bail Compliance team will also install CCTV cameras in strategic places in the applicant's home. The applicant must present themselves to the camera on demand during this remote check (number and frequency of checks to be determined by the courts).

Strike's Bail Compliance team is comprised of former Police Officers, former Military members and Senior Investigators with a minimum of 25 years experience in the field. The team will conduct compliance checks wearing body worn cameras to ensure accurate documentation of each interaction.

Strike will prepare ongoing investigative logs of its in-person and remote monitoring, and these logs, including recordings, may be provided to the officer-in-charge or any police service upon request and without notice to the applicant. Strike is currently monitoring applicants in multiple Provinces across Canada.

The fees associated with Strike's Bail Compliance Services (including compliance checks, remote monitoring, equipment installation, affidavits and court testimony) are the responsibility of the Law Firm representing the applicant, and Strike may suspend services if fees are not paid.

Strike Consulting Inc. is insured as per the requirements of the Ministry of the Solicitor General and has taken on additional insurance to support the onerous requirements of the Bail Compliance Program.

Guiding Principles

Pretrial detention is the exception rather than the rule. The presumption is that an accused person should be released at the earliest opportunity and on the least onerous terms. See R. v. St. Cloud, 2015 SCC 27, R. v. Antic, 2017 SCC 27, R. v. Myers, 2019 SCC 18 and R. v. Zora, 2020 SCC 14.

Sections 11(d) and 11(e) of the Charter form the underlying grounds for the Supreme Court's pronouncements. Every accused is presumed innocent until proven guilty - 11(d) and everyone has the right not to be denied reasonable bail without just cause - 11(e).
